Pre-Paid Legal Advice:
Get smart: What to do after a work related injury in Pa.
By Welch, Gold & Siegel – Pre-Paid Legal Services, Inc., Pennsylvania
Most people think that a work related injury will never happen to them. But when it does, what should you do?
Workplaces should have procedures in place to deal with work related accidents and injuries. There are always those workplaces that don't follow the rules or only have rules posted in English when much of their workforce speaks Spanish or other languages. Some rules may exist loosely do not get passed along to employees.
If you or a family member has been injured at work, follow these necessary steps:
- Get medical attention after a work related injury in Pa., whether onsite of your workplace for some basic first aid, from a doctor, or if an emergency, from a hospital. If you get basic first aid at work but later feel ill or not properly cared for, visit a doctor or ER.
- Report the accident, if you are able to speak. Your supervisor should report the accident to OSHA or the Pennsylvania state OSHA for investigation especially if employees were hurt or continue to be hurt from routine work functions. Asked a loved one or friend to write down your thoughts if you are unable and keep them in a safe place and give them to your lawyer.
- Seek Pennsylvania workers’ comp legal advice. This may seem harsh but consider the fact that your employer has a lawyer; your employer's insurance company has many lawyers; so most likely you will need a lawyer also.
It’s far better for your workers compensation lawyer to talk to their lawyers than for you to talk to their lawyers.
Don't be apologetic about talking to a lawyer or retaining one; it's your legal right. A lawyer will immediately advise not to sign any documents from your employer or your employer's insurance company. Listen to your workers’ compensation lawyer.
Your lawyer will investigate the facts about your work related injury accident. He or she will talk to witnesses, review the injury report and accident scene, examine workplace safety standards and injury procedures, and help you and your family cope during these trying times.
