Pre-Paid Legal Advice:
Medical treatment after work related injury
By Welch, Gold & Siegel – Pre-Paid Legal Services, Inc., Pennsylvania
In Pennsylvania medical treatment for work-related injuries is covered.
In Pennsylvania, employees have the right to select treating physicians with some limitations for the first 90 days. Your legal rights for medical treatment are covered by the Workers Compensation Act.
During the first 90 days
- You have the right to medical treatment providing it is done by the six choices provided by your employer. Your employer has to pay for your medical treatment.
- You have the right to choose which of the six provided choices you want to treat you.
- You have the right to switch among the six provided choices and if you're referred to another not in the six, you can be still covered by the referral.
- You have the right to receive emergency medical care from anywhere but non-emergency must be from the six choices.
- If a listed provider recommends surgery, you have the right to a second opinion. If you choose the treatment of the second opinion, you must use a listed provider and have the treatment within 90 days.
- You must visit one or more of the six providers within the first 90 days of your injury.
- If you seek treatment for your work injury within the first 90 days from other than the six providers, your employer may not need to pay for your medical treatment.
After the first 90 days
- You have the right to receive treatment from any medical care provider whether he/she is on the employer provider list or not. The treatment must be necessary and documented. Your employer is responsible for payment.
- You must notify your employer within 5 days of seeking medical care from a provider not on the list. The employer is not required to pay until notified.
